1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and ConfigCloud Inc. ("Company", "we", "us", or "our"), concerning your access to and use of our website and services.
By accessing or using the ConfigCloud website and services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the services.
You represent that you are over the age of 18. The Company does not permit those under 18 to use the services.
2. Intellectual Property Rights
Unless otherwise indicated, the website and its content, features, and functionality are owned by ConfigCloud Inc. and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ConfigCloud Inc.
You are granted a limited license to access and use the services and to download or print a copy of any portion of the content to which you have properly gained access solely for your personal, non-commercial use.
3. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our services.
You are responsible for safeguarding the password you use to access the services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.
4. Subscription and Billing
Some of our services are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (daily, weekly, monthly, or annually), depending on the subscription plan you select. At the end of each period, your subscription will automatically renew under the same conditions unless you cancel it or ConfigCloud Inc. cancels it.
You may cancel your subscription either through your online account management page or by contacting our customer support team. You will receive a confirmation email upon cancellation of your subscription.
A valid payment method, including credit card, is required to process the payment for your subscription. By submitting such payment information, you automatically authorize ConfigCloud Inc. to charge all subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, ConfigCloud Inc. will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.
5. Prohibited Uses
You may use our services only for lawful purposes and in accordance with these Terms. You agree not to use the services:
- In any way that violates any applicable national or international law or regulation.
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
- To send, knowingly receive, upload, download, use, or re-use any material which does not comply with these Terms.
- To transmit, or procure the sending of, any advertising or promotional material, including any junk mail, chain letter,spam, or any other similar solicitation.
- To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
- In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the services, or which, as determined by us, may harm the Company or users of the services or expose them to liability.
Additionally, you agree not to:
- Use the services in any manner that could disable, overburden, damage, or impair the services or interfere with any other party's use of the services.
- Use any robot, spider, or other automatic device, process, or means to access the services for any purpose, including monitoring or copying any of the material on the services.
- Use any device, software, or routine that interferes with the proper working of the services.
- Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the services, the server on which
